By proceeding with a booking or clicking “I Agree,” you (“Charterer”) agree to be bound by the following Terms & Conditions.

CHARTER EXPERIENCE

1 Fully Crewed Operation

All charters are privately operated by Wave Rider Yacht Inc. (“Company”) and include a professional captain and crew.

2 Captain Authority

The Captain holds absolute authority over all operational and safety decisions, including route adjustments, onboard conduct, and early termination of the charter if deemed necessary.

3 Passenger Limits
Passenger capacity is strictly enforced in accordance with Transport Canada regulations:

• GZ-ANTARES: Maximum 15 persons (including crew)
• GZ-PHOENIX: Maximum 45 persons (including crew)

4 Navigation Area

All charters are restricted to Lake Ontario within approved operational limits.

BOOKING, PAYMENTS & CONFIRMATION

1 Deposit
A 20% non-refundable deposit is required to secure all bookings

2 Final Payment
The remaining balance must be paid no later than 7 days prior to departure.
Unpaid bookings may be automatically canceled without notice.

3 Pricing
All pricing is subject to applicable taxes and additional services requested.

CHARTERER RESPONSIBILITY & CONDUCT

1 Guest Responsibility
The Charterer assumes full responsibility for the behavior and compliance of all guests

2 Prohibited Conduct
The following are strictly prohibited:
• Illegal substances or weapons
• Excessive intoxication or disruptive behavior
• Smoking except in designated areas when permitted
• Cannabis use on board

3 Safety Compliance
All guests must comply with crew instructions and safety protocols at all times.

3.4 Safety Conduct
Swimming, diving, or entering the water is prohibited unless explicitly authorized by the Captain.
Unsafe or reckless behavior may result in immediate termination of the charter without refund.

ALCOHOL POLICY

1 BYO Alcohol
Guests may bring alcohol in accordance with Ontario laws.

2 Service Control
The Company and Captain reserve the absolute right to limit or terminate alcohol consumption
at any time.

3 Intoxication
Any guest who is deemed intoxicated, unsafe, or disruptive may be denied boarding or removed
from the vessel without refund.

CANCELLATION & RESCHEDULING

1 By Charterer
• 14+ days prior: Full refund
• Within 14 days: No refund; one-time rescheduling permitted within 12 months
• Statutory holidays and long weekends: All bookings are final

All cancellations must be submitted in writing.

2 By Company
The Company reserves the right to cancel or modify charters due to:
• Unsafe weather conditions
• Mechanical issues
• Safety concerns
In such cases, Charterers may choose:
• Rescheduling, or
• Full refund

3 Weather Policy
Charters operate in light rain and standard marine conditions.
Weather preferences or discomfort do not qualify for refunds.
All weather-related decisions are made solely by the Captain.

BOARDING & TIMING

1 Arrival
Guests must arrive at least 30 minutes prior to departure

2 Time Policy
Charter time begins at the scheduled time regardless of actual boarding.

3 Late Arrival & No-Show
Late arrivals and no-shows are not eligible for refunds or time extensions.

4 Boarding Window
The first and last 10 minutes of each charter are reserved for boarding and disembarking.

FOOD & BEVERAGE

1 Outside Food
Guests may bring their own food and non-alcoholic beverages.

2 Catering
The Company does not provide catering unless otherwise arranged.

3 Cleanliness
Guests are responsible for maintaining reasonable cleanliness onboard

DAMAGES & SECURITY HOLD

1 Liability for Damage
The Charterer is financially responsible for any damage caused by themselves or their guests.

2 Security Hold
A security hold of up to $1,000 may be applied and charged in cases of:
• Damage
• Excessive cleaning
• Delays or policy violations

SAFETY & ACKNOWLEDGMENT OF RISK

1 Assumption of Risk
All guests acknowledge that participation in marine activities carries inherent risks, including
injury, illness, or accident.

2 Personal Responsibility
All guests board and participate at their own risk.

3 Safety Briefing
A mandatory safety briefing will be conducted prior to departure.

LIMITATION OF LIABILITY

1 Liability Waiver
Wave Rider Yacht Inc. shall not be held liable for:
• Personal injury, illness, or death except in cases of gross negligence
• Loss, theft, or damage of personal belongings

2 Indemnification
The Charterer agrees to indemnify and hold harmless the Company, its owners, crew, and
affiliates from any claims, damages, or liabilities arising from the actions of the Charterer or their
guests.

MEDIA RELEASE

1 Promotional Use
The Company may capture and use photos or videos for marketing purposes.

2 Opt-Out
Charterers may request in writing prior to the charter that no media of their group be used.

GOVERNING LAW & DISPUTES

1 Jurisdiction
This agreement is governed by the laws of Ontario, Canada.

2 Dispute Resolution
Parties agree to attempt mediation prior to initiating legal proceedings

GENERAL PROVISIONS

1 Severability
If any provision is deemed invalid, all remaining provisions shall remain in full effect.

2 Updates
The Company reserves the right to update these Terms at any time.
The version in effect at the time of booking shall apply.
